Understanding CUSMA compliance

What Canadian exporters need to know

Despite U.S. tariffs imposed on Canada under the United States (U.S.) International Emergency Economic Powers Act (IEEPA), Canadian exporters can still benefit from duty free access to the U.S., if their goods are Canada–United States–Mexico Agreement (CUSMA) compliant.

Being CUSMA compliant means that goods meet the CUSMA rules of origin and qualify for preferential tariff treatment.

What this means for your business

  • Over 98% of tariff lines and 99.9% of bilateral trade with the U.S. are eligible for duty free access under the CUSMA.
  • Canadian goods must be certified as compliant with the CUSMA rules of origin by the exporter or producer (this means the goods are eligible for preferential tariff treatment), and U.S. importers must claim the preference to benefit from duty free treatment.

Ensure your product meets the CUSMA rules of origin and complete a certification of origin

  • Determine your product’s HS code.
  • Determine if your good meets the rules of origin (product specific rules of origin are written based on HS codes).
  • Complete a certification of origin (there is no requirement for this information to be provided on a specific form. It may be provided on an invoice or any other document.)
  • Consider using a template certificate to avoid errors.
  • Provide the certification of origin to your U.S. importer so they can claim the preferential tariff treatment.
  • Request an advance ruling for certainty about how the good will be treated upon entry into the U.S.
  • Contact a certified customs broker for additional support:

For goods imported into the U.S., the final decision on the classification and tariff treatment of a good rests with the U.S. Customs and Border Protection (CBP).

La diversification des exportations fait‑elle partie de votre stratégie commerciale pour 2025?

Excellente nouvelle! Le programme de financement CanExport PME accepte maintenant les demandes pour les projets qui débuteront après le 1er avril 2025.

CanExport PME couvre jusqu’à 50 % des dépenses admissibles, notamment :

  • la participation en personne aux missions commerciales, salons commerciaux, réunions ou conférences;
  • la collecte de renseignements sur le marché (recherches, rapports et études sur mesure);
  • la protection de la propriété intellectuelle sur les marchés internationaux;
  • et plus encore!

Pour être admissible à ce programme de financement, votre entreprise doit satisfaire aux critères suivants :

  • être à but lucratif;
  • être une personne morale constituée en société, une société à responsabilité limitée ou une coopérative au Canada;
  • avoir un numéro d’entreprise actif de l’Agence du revenu du Canada (ARC);
  • avoir entre 1 et 500 employés équivalents à temps plein (ETP);
  • avoir déclaré des revenus annuels entre 100 000 $ et 100 000 000 $ au Canada au cours de son dernier exercice financier (ou au cours des 12 derniers mois dans le cas des déclarations mensuelles ou trimestrielles).

Accent accru sur la diversification des exportations : Afin d’encourager les demandes axées sur un plus vaste éventail de marchés mondiaux, les demandeurs peuvent cibler soit les États‑Unis soit les marchés internationaux, mais pas les deux.

Ces changements peuvent avoir une incidence sur votre admissibilité et sur vos options de financement. Lisez attentivement le Guide du demandeur du programme CanExport PME pour vous assurer de satisfaire aux critères.

Apply for CanExport SMEs funding today

Is export diversification part of your business strategy for 2025?

Great news! The CanExport SMEs funding program is now accepting applications for projects starting after April 1, 2025.

CanExport SMEs covers up to 50% of eligible expenses, including:

  • In‑person participation in trade missions, trade shows, meetings, or conferences
  • Gathering market intelligence (custom research, reports and studies)
  • Applying for intellectual property protection in international markets
  • And more!

To qualify for this funding, your company must satisfy the following criteria:

  • Be for‑profit
  • Be an incorporated legal entity, limited liability partnership (LLP) or cooperative in Canada
  • Have an active Canada Revenue Agency (CRA) business number
  • Have between 1 and 500 full‑time equivalent (FTE) employees
  • Have between $100,000 and $100 million in annual revenue declared in Canada during its last complete tax reporting year (or during the last 12 months for monthly and quarterly filers)

To better serve Canadian businesses, we’ve introduced the following changes to the program:

  • Greater focus on export diversification
  • Changes to eligible expenses
  • New documentation requirements

Greater focus on export diversification: To encourage applications focused on a wider range of global markets, applicants may target either the United States or international markets, but not both.

These changes may impact your eligibility and funding options. Carefully review the CanExport SMEs Applicant’s Guide to ensure you meet the criteria.
